When In Trouble Hire A New Jersey Criminal Lawyer Immediately

By Donna Murray

At any given time law enforcement agencies are investigating many thousands of people suspected of criminal activities and numerous arrest are made annually. The vast majority of these people are ordinary citizens that lead ordinary lives. Being arrested or investigated is a very serious affair with many possible long term consequences. Anyone in such a situation should immediately hire the services of a competent New Jersey criminal lawyer.

When arrested certain rights are automatically invoked. One of these rights is to refuse to answer official questions or to make a written statement until an attorney is present. Most legal experts agree that it is best to exercise these rights. Arrested individuals are often stressed and nervous and they are apt to say things that will only harm their cases in the court. They mistakenly think that their cooperation will count in their favour.

As soon as an attorney agrees to take a case he will first make sure that all the regulations have been followed meticulously by the investigating authorities. He will also consult with his client and he will be present when his client makes a statement. The authorities are obliged to provide the attorney with the facts that led to the arrest or investigation and he will study the case against his client very carefully.

The attorney will do everything possible to have his client released on bail. In many cases this can be done very quickly, especially if the accused is a first offender and if there are no reasons to believe that he will contravene the conditions of bail. These conditions typically include a ban on travelling and a strict instruction not to contact any witnesses or to interfere in the investigation.

The conditions of bail must be taken very seriously. If the accused break any of the conditions he stands a good chance of being arrested again and remanded in custody until his case is heard. He may also face additional charges, which will only add to his problems. The best course of action is to religiously follow the conditions of bail.

One of the biggest problems faced by defence attorneys is clients that do not tell them the truth or that omit important facts. No attorney can prepare a decent defence unless he is fully informed. Accused should always be brutally honest with the attorneys, even if the facts are incriminating and embarrassing. Attorneys have been known to excuse themselves from a case because their clients are dishonest.

When the accused is a first offender it is often possible for his attorney to reach a plea bargain. In terms of such an agreement the accused will plead guilty and accept the sentence that were negotiated between his attorney and the prosecutor. It is the quickest and easiest way of dealing with charges. Of course, if the defendant is not guilty, he should insist upon the matter proceeding to court.

The worst thing anyone facing criminal charges can make is to represent himself. Even innocent accused can easily make mistakes that will haunt them for the rest of their lives. The justice system is complicated and there are many potential pit falls. The only answer is to get professional help when accused of committing a crime.
